Why is my ERC Refund delayed?

There could be several reasons why your ERC refund is not being processed:

1. Filed After September 14, 2023, Moratorium

If your claim was filed after September 14, 2023, it falls under the IRS moratorium on processing new ERC claims. Claims filed since this period will not be processed until the moratorium is lifted.

2. Issue with the Filing

If there are errors or missing information on 941X or 943X, the IRS will not process it until these issues are resolved. Ensure all required documents and details are accurate and complete.

3. Flagged for Audit

Your claim may have been flagged for audit. The IRS is training ERC auditors and is flagging ERC claims for audit when those resources become available. Claims flagged for audit will not be processed without an exam by an IRS agent.

4. Return Lost or Refund Stolen

Although rare, It’s possible that your claim was lost or misplaced by the IRS, or possibly stolen by a bad actor. You should contact the IRS to verify your return was received, and if stolen, special IRS forms need to be filed for the IRS to reissue your refund.

IRS announces “Next Stage” of Employee Retention Credit work

Last week, the IRS announced in IR-2024-169 that it is moving into the “next stage” of Employee Retention Credit processing, updating taxpayers that are anxiously awaiting their refund.

Here are three key points to know:

  • 📢The IRS “announced plans to deny tens of thousands of improper, high risk Employee Retention Credit claims”

  • 📢They estimate that “between 60% and 70% of claims show an unacceptable level of risk”, requiring additional analysis before processing”

  • 📢 “Between 10% and 20% of claims show a low risk… and the IRS will begin judiciously processing these claims… with the first payments in this group will come later this summer.”

Businesses looking to be proactive should partner with a reputable tax professional to help them determine the status of their claim.
